Fed speak — “play for fumble” and focus on process crimes (lying/tampering/obstruction). Fumbles are usually pursued selectively and with great discretion. Stone/Flynn cases are particularly bad given that underlying target crime (Russian hoax) did not occur.

Stone sent stupid threatening texts to one of the witnesses, which the witness testified he didn't take seriously. Nonetheless such threats were technically aggravating factors for sentencing purposes.

To my basic understanding, yes, though I'm no lawyer and the circumstances were different. Really I don't like the idea of Stone, Brennan, or Clapper getting special treatment due to political connections.

Comey and Clapper used the power of the FBI, CIA, NSA and FISA to illegally spy on a political campaign and then a Presidents administration. That is a bigger deal than someone threatening another guys DOG on Twitter.
