Exactly zero of them heard my FULL argument. It exists only on Periscope. That would make your experts ignorant in this case. See the problem with experts yet?

Scott. I heard your Periscope argument. You were wrong. There is no category of “public figure” that has *more* protection against defamation than a private figure.

Maybe I misheard. I was pretty sure you said that since you aren’t a political figure, but a public figure who is also a brand, you could be more easily defamed by a journalist. Did I misunderstand you?

The context was demonstrating damage. Sounds like you missed a lot.

No, I got that part too, the part where you said “I don’t have to show you my spreadsheet of actual damages.” Which is also incorrect, btw, you definitely have to show damages.

What I’m taking issue with is this statement: “if I were an elected official and somebody said I was the Louis Farrakhan of incel white nationalists, I wouldn’t have any case. […] But that decision allows that you could still be liable to a public figure, like me.” That’s wrong.

There is no distinction between “political figures” and “public figures” in Times v. Sullivan. That is a distinction you have fabricated out of whole cloth.

This is a discussion that starts at about 1:02:03 into your Periscope video from yesterday, if anyone wants to listen to verify my extremely rough transcript.

Can we agree Twitter is not a vehicle for making a legal argument? All I see is you misinterpreting my points and getting others riled up on the same.

If you’re uncomfortable discussing your own words in this forum, that’s your right. I just wanted to bring them out of the hour-long Periscope video you posted and into a format where your points could be more easily and widely seen.

How is Twitter "not a vehicle for legal argument" when "you obviously have no case" comes well within the character limit?

I thought negligence was for private figures and reckless disregard came under actual malice? Do I have that wrong?
