Yes. It's actually easier for you to sue me for calling you a goat-fucker than it is for Adams to sue Cook for similar. But you still wouldn't win that suit, and neither could Adams win this one.

Actual malice requirements mean that Adams has to prove that Cook made the statement knowing or strongly suspecting that they were false. If he believes them to be true, that's impossible. And Adams has to prove that Cook believes the statements are false.

No, it doesn't, because it's a statement of opinion. Regardless, Adams would also need to prove damages attributed to the statement, which he cannot do.

And again, that reckless disregard thing hinges on Adams' ability to prove that Cook made those statements knowing they were false. If he believes them to be true, Adams' fails that test.

His status as a journalist has exactly nothing to do with whether or not his speech is protected. Adams has a great case for trespass of feels, and nothing else.

I don't disagree, but this isn't exactly a landmark situation. This is a cartoonist getting his ass chafed over internet insults.

Actually, it might be more interesting than you think. It would answer the question of whether a credentialed editor of a news organization has the same responsibility to get libelous facts right compared to randos on the Internet. When did that question get settled?

It goes back to the "rational man" standard. Are we to agree that a person who puts themselves forth as professional in their field have more responsibility to be rational than someone who is not? With authority comes responsibility.

Sure that may have been the case 30 years ago when a journalists personal opinions were less accessible and less likely to cause serious harm. Social media has changed everything in a material way so to act as if a judge will look at things the same as 30 years ago is low IQ.
