Ok. I will let the dust settle here before commenting again. I can think of at least three different categories of "rights" and several of "benefits." Until things get specific I'll just sit this out. I generally agree with

"Unalienable rights" exist independent of any institution that is charged with defending said rights. The Constitution is just our best attempt to create a legal and ethical framework that preserves individual rights at a nation-state scale. Brad is correct. The frame is wrong.
