All sales from a dealer have a NICS ( National Instant Check System) background check done. All of them. Across the country. Private sales from one citizen to another do not have a federal check.

There is no gun show loophole, sales go through the same checks as at retailers There is a private sale loophole in some jurisdictions California is not one of those jurisdictions, background checks and waiting periods still apply, and have for decades

My husband was executor for his dad who willed three valuable rifles to his three grandsons. One grandson who resides in CO preferred to let my husband keep it. Because the laws in CA are such a nightmare, he ended up spending over $200 to legally ship it to the grandson.

If I leave my shotgun in my buddy’s car after pheasant hunting for more than 72 hours he’s compelled by law to make me go thru a background check to get my own gun back. Pretty silly, don’t you think?

When I grew up in SoDak everybody had a rifle for deer and a shotgun for birds--usually on a rack in the pickup. Nobody thought a thing of it. Of course, nobody shot anybody else. That sort of thing was frowned on. And they had a good chance of getting their head blown off.

The "gun show loophole" is a myth. Private sales can, and do happen at gun shows (and many other places), but dealers are required to do background checks as usual.

The only loophole to the background is really private sales. Which is nearly impossible to fix since there is no registry of who owns what. If my glock changes owners nobody really knows but me and the new owner and would only possibly be reviewed if it was involved in a crime
