    The law states that children with disabilities are entitled to FAPE under IDEA/504. Parents shouldn’t have to incur a huge financial cost to educate their children when they are already paying TAXES & the LAW says their child is entitled to an education.

    I just tried to file an OCR complaint using the new and improved version ... all it did was send me to the old version of the complaint system which I cannot navigate 🤯

    I guess 1 in 5 children, 20% of children, whose civil rights are being violated don’t matter to law academia & those in the Ivory Tower. How sad. Rates of autism & ADHD are increasing and this crisis is only going to get worse in the coming years. Yet, silence.

    They know it won’t work. It will punish kids and make them feel even worse than they already do. Holding back 3rd graders is HORRIFIC to their self esteem. You’d think it’s common sense but again you’d think kids actually learn in public school.

    Some parents are seen as being less of one in their social circles if they don't prep. It just creates this ridiculous insanity. It makes as much sense as prepping your child for the CARS or ADOS-G to rule out autism or the Conners CBRS for ADHD. I just wrote a piece about that.

    No teeth, no compliance, no enforcement, no accountability, no justice for so many children & families. And silence from politicians & education law professors & education experts who are only focused on funding & evil charters/privateers. Nobody cares about the .

    Are there ANY education law professors, in the entire country, focusing on this civil rights crisis? One would think they would be all over this issue, but nope. Their kids are probably safely tucked away in private schools so they don’t care. 🤷‍♀️

    We need to change the law to add enforcement provisions to SpEdLaw — provisions with teeth. Example: ‘For each failure to provide FAPE, follow the IEP, or keep a child safe, school loses 2 years of money earned from of daily attendance allotment’ would incentivize IEP compliance.

    School or task refusal are because a child doesn’t understand something and is avoiding failure. It happens when a child is not appropriately accommodated. That’s not the child’s fault he’s not being appropriately accommodated.

    The laws will never change fast enough,if ever. USDOE would have to be abolished, then each state would have to revamp its school liability laws. USDOE *could* change terms of its grants requiring that states increase their school liability, but states will go to court.
