TODAY: Dems are reintroducing a bill to guarantee the right to travel across state lines for an abortion. No state has yet attempted to prosecute someone for helping another person travel for the procedure but a couple states have explored doing so.

The other thing to pay attention to— in addition to this new enforcement tool that we're likely to see more of— is that the FTC also is in the process of proposing new rules on commercial surveillance and data security

Though ad platforms and data aggregators are not the focus here, the FTC could follow up to make sure that these companies are not inadvertently in possession of data that was collected in ways that violated the HBNR

If the court agrees with this order, GoodRx is going to have to stop sharing personal health data with Google, Facebook, etc. for advertising purposes and make sure that third parties delete data it's previously shared, which is also a big deal.

The rule was put into place back in 2009 in a stimulus bill and has never been used. But the commission has been signaling via public statements that it is going to interpret the rule this way.

Regardless, the narrative is taking hold in other ways. Lawyers are starting to push the idea that algorithms are products—faulty products—subject to product liability law. That may also get them around 230.

Unlike content, algorithms and targeting technology are not necessarily protected. Next month, the Supreme Court will start mulling this question when it hears arguments for Gonzalez v Google. So we may get an answer on that.

Regulators at this point have held many hearings on the many harms associated with social platforms. But the trouble has been section 230, which prevents these companies from getting sued for user posted content. Lawmakers also want to avoid limiting free speech.
