On May 11 1973 charges against my father, Daniel Ellsberg, and co-defendant Tony Russo were dismissed for their copying of the Pentagon Papers, a Top Secret history of the Vietnam War. The judge cited massive government misconduct. My father had faced 115 years in prison.

This is true patriotism. This is actual defending of the Constitution. This is courage. This is acting on behalf of the truth. These acts changed history at the time. And they resound throughout history because they can give courage to people of all times.

Judge Byrne did not earn full marks. He only acted after it was revealed he had met 2x with the President and his men to discuss an appointment as head of the FBI following the conclusion of the trial. As it turned out, history did not smile on Judge Byrne.

i remember listening to him, years later in the 1980s, speak to students at UC Berkeley about the ongoing state crimes. I was always inspired by his courage!
