if you are going to send some signed stuff back, a protocol extension to get the client to just return a signed ack payload would be ok?

No because that requires the client support the protocol extension, which you can't assume.

So you got syn, replied with synack and put the state into a ping ? (And now will need to reconciliate ping reply and ack ?) though this could solve the spec violation whereby “syncookied” synack is not retransmitted if lost - keep bouncing the ping and use that as clock :)

Almost all firewalls discard ping packets these days, routers preferentially drop them in congestion situations...
