It's a completely empty threat anyway. There's no legal basis for the threat. It's hardly unethical to upstream their Linux changes either.

There were actual license violations and cases where the grsecurity trademark wasn't being used per their requirements, sure. This isn't.

They're majorly shooting themselves in the foot. It makes it look like any real issues they had in the past were bogus even if they weren't.

They base their changes on the Linux kernel and they don't publish any kind of long-term history of changes with attributions at all.

It's clearly an empty threat. If they aren't going to sue companies for legitimate reasons it's hard to believe they would over bogus ones.

It seems like they're grasping for loopholes to effectively undo publishing their code in the first place. It doesn't work that way.

If they don't want to publish future changes, that's their choice. Of course if a customer leaks it to KSPP then KSPP can keep using them.
