Well yeah, but I'd rather them be subject to a legal requirement to make it an "opaque transport layer".
I'd prefer it to just be "if it's opaque, you're clearly not responsible for content, therefore no portals ever"
ie, you have an ISP account that you auth to, but no WiFi portals, encrypt everything, and no liability for providing free WiFi
Rather than having to trust the benevolence of Google, that is.
