This sounds implausible - was it perhaps during evolution of ACA instead? ACA doesn't just ban preexisting conditions from consideration. It's a whitelist approach - price must be a function of only location, age, and smoker status.

It's just data mining, which is pretty easy. There is nothing in the law that prevents lifestyle ratings. We were approached shortly after the ACA was passed.

For employers that self-insure or group policies, crap like this may be possible (not clear to me how the cost or discount is passed on to the employee) but marketplace plans are fixed-price and can't exclude anyone in the location they're offered in.

You can still aggregate data by zip code and use "general behavior patterns" when setting rates.
