    This piece is so good. Delves into a lot of stuff that I didn't even know or think about. Eg: even if (as my blog says) iPhones != an "interactive computer service" under 230, Apple does provide ICSes; Barr could just strip immunity from ALL of Apple for not backdooring iPhones.

    I could easily see it becoming "best practice" that phones and tablets only allow apps to be installed from trusted sources, and those sources can't serve up E2E apps

    Over the last 25 years, while law enforcement was off complaining about encryption, we've LITERALLY BUILT A SOCIETY THAT'S DEPENDENT ON IT. We absolutely cannot afford to scare service providers away from providing it themselves or allowing it over-the-top of their own services.

    Not to mention financial data and who knows what else. If you tell providers "stop allowing E2EE, and also, stop allowing encrypted files to be transmitted over your services," and they do it, you break the data security of EVERYTHING, and it'll touch SO MANY economic sectors.

    Also, I used to be a Biglaw litigator. A routine part of my job was producing discovery in electronic form to opposing counsel. Guess how I protected my clients' internal records? I encrypted the files before sending them. LAWYERS HAVE ETHICAL OBLIGATIONS TO PROTECT CLIENT DATA.

    All these big tech companies have also gotten into the health business. So, you're going to strip their Section 230 protection for CSAM, because somewhere else in their business, they provide data security measures that HIPAA *requires*? Great idea, genius.

    So then, OK, obvious response: another "best practice" that says "figure out a way to block encrypted files from being transmitted over your service." I don't even know if that's possible, but it'd be just the absolute worst idea. We WANT files to be encrypted when they're sent!

    Christ, the EARN IT Act is just so brain-breakingly stupid. It would allow the AG to write "best practices" making providers legally liable for offering end-to-end encryption. OK, well, what's to stop people from separately encrypting data and *then* transmitting it?

    7. I am *deeply* skeptical of Barr’s motivation here. After several years of opposing encryption on very different grounds (criminals, terrorists) and asking for access only with a warrant, suddenly making a hard right turn and saying “think about the children” — feels cynical.
