OSHA has no more authority to enforce this (there’s no statutory authorization) than CDC had to issue the eviction moratorium. Which is to say they both have ZERO authority to do these things. Congress makes the laws in a constitutional republic.
Can it go right to Supreme Court ?
No because osha was passed in 1970
Challenging an EO's constitutionality, in my opinion, is best handled by the judiciary. But then, I read EOs before freaking out about them. (And I have most definitely freaked out about some EOs in the past!)

Yes. It is also pure political theater, meant to fail just like the eviction moratorium. This way they blame their failures on SCOTUS.
