@NRO ran a piece, goodness, maybe back when GW Bush was prez, about preemptive strikes, demonstrating they had been used early in the Republic. How do I know? I subscribed to it for the better part of 25 years, beginning in 1991 or so before the Never Trump nonsense.
I'm for fidelity to the Constitution, but you don't want to wrap the executive's hands too tightly. If the executive has a strict "only act after we are hit" policy, then the executive may not be able to prevent a tragedy. What if intelligence had been provided about 911?
