    As the court wrote today, "[t]he public interest is served by a valid reapportionment and is harmed when the government acts contrary to federal law." We couldn't agree more, and will continue to fight for what's right.

    In a unanimous opinion, the court found the plaintiffs had demonstrated a substantial risk that the policy would diminish congressional representation in certain states, and held that the Memorandum violated federal laws governing the census and reapportionment.

    We are proud to support the plaintiffs in Useche v. Trump, which challenged the 7/21 Presidential Memorandum announcing President Trump’s intent to exclude undocumented immigrants from the population count for the purposes of apportioning seats in the House of Representatives.

    🚨 BREAKING: Major census victory! 🚨 Today, a three-judge panel in Maryland became the third court to order that ALL persons living in the U.S. must be included in the for purposes of apportionment, regardless of citizenship or immigration status.

    The court also ordered to conduct two sweeps each day in all states with upcoming ballot deadlines, continuing a series of oversight and enforcement orders over election mail the court has issued over the past week.

    This order comes as newly-released USPS data showed that 20% of Pennsylvania ballots that were processed on Wednesday had not been delivered in a timely manner—compared to 5% nationally.

    🚨Updates in our case: Earlier today, Judge Sullivan instructed processing facilities in regions of NC & PA to conduct two sweeps of their facilities on Friday and to work with local election boards to ensure delivery of all ballots in its possession by 5PM on 11/6.

    While the USPS has thus far failed to comply fully with the court’s orders, and although the number of outstanding ballots remains unclear, this critical new oversight could impact races at the state and national level.

    Vote Forward v. DeJoy has ALWAYS been about ensuring that election mail is not held up by delays—and most importantly, that every eligible ballot sent by mail is counted in this year’s elections.

    Update in our case: We continue to achieve increased oversight of the USPS. Mailed ballots remain outstanding across the nation—including in NC, PA, & MI—and we will fight to ensure EVERY ballot is delivered by the statutory deadline in each state.

    . officials must search their facilities for undelivered mail-in ballots and immediately send them to election officials in the following areas: Central PA, Philly, Detroit, CO/WY, ATL, Houston, AL, Northern New England, Greater SC, South Florida, Lakeland, and AZ.

    Big update in our case: A federal judge ordered the USPS to immediately sweep facilities in several states by 3pm EST to “ensure that no ballots have been held up and that any identified ballots are immediately sent out for delivery.”

    🚨 BREAKING 🚨 Tonight, denied a request to upend a consent decree reached by NRF-supported plaintiffs in NC state court! The consent decree extends the ballot receipt deadline for ballots postmarked by Election Day to 11/12. But don’t wait—cast your ballot ASAP!

    On Tuesday, plaintiffs supported by the NRF achieved a major victory in court. The 4th Circuit rejected an attempt to halt the implementation of a consent decree expanding access to in North Carolina.
