They legally can't if he filed a proper legal DMCA request, however Neiron has no real basis if they appeal, so if the creators of the vids appeal the strike a few times, he will have to back out because otherwise he'd risk getting his ass sued.
YouTube, something needs to be done. You guys need to at least respond. But please actually do something about this situation.
