Sure, it’s unfair, but that’s how law works. Since copyrighted material was found in the video, that means that technically “your video could not exist without it” so therefore they can monetise. Depends whether it’s fair use or not...

But it's not even a fraction of the video. We've seen cases like with H3H3 Productions that using small segments of work are fair use regardless of how much of it is used. This company is flexing their legal muscles over something so small as 5 seconds of video. It's pathetic.
