It may be an open carry state but the Wal-Mart may have been a gun free zone. If he entered with a gun with the intent to cause chaos one could say the "yelling fire in a theater" rule applies.

That depends - If they find his "Manifesto" or something similar, murderous intent can be proven. Walking in his kind of gear to a walmart soon after a shooting may not be illegal, but it certainly is dumb!
