There's a good chance that Smartmatic would be classed as a public figure and need to prove that 1) what Sydney said was false and 2) Sydney intentionally made false statements. More than likely, Smartmatic won't want to engage in discovery and even if they do they can't prove
the second prong of the test. Their only chance to win this case, would be to get it before a judge willing to class Smartmatic as a private entity, which is certainly possible given how the courts have been behaving.
