Ok, so the 3rd Circuit is adopting the briefing schedule. Time for fun!pic.twitter.com/nyBM9eRa2B

My reaction: I’ve said this before, but Courts are quite likely to give the President a lot of procedural leeway. That’s why Judge Brann let Rudy babble for 2 hours before ripping him apart. They don’t want to be seen throwing the President out on technicalities. /2

So of course, they could just have denied the motion to expedite, but then they’d be criticized for not giving the President a chance. Instead, they’re saying “oh you want to file a brief today? Have at it.”

I wouldn’t read anything about what the Court thinks about the merits of anything into their decision to let Trump have his (absurd) shot.

Doesn't that mean they'll also allow for the 2nd amended complaint to be retried by Judge Brann's court ?

That's what happens if 3rd circuit decides in their favor. So Rudy has to make the case for that, today. Given that nothing they're appealing changes the basic standing argument, it's a really stupid thing to appeal anyway.

24 hours to respond to a brief is quite insane.

Yeah. But the appeal is insane and so weak that any answer or even no answer will defeat it. (I mean the District Court decided rightly on standing, so they're asking leave to amend something they don't have standing to bring)

Are the Trump/McConnell judges on the 3rd Circuit?

I would think in the same vein they may allow them to amend the complaint. Undue delay may not be strong enough, as the district court basically said it didn't want to go through another round of briefing/oral args.
