Doesn't that mean they'll also allow for the 2nd amended complaint to be retried by Judge Brann's court ?
That's what happens if 3rd circuit decides in their favor. So Rudy has to make the case for that, today. Given that nothing they're appealing changes the basic standing argument, it's a really stupid thing to appeal anyway.

Yeah. But the appeal is insane and so weak that any answer or even no answer will defeat it. (I mean the District Court decided rightly on standing, so they're asking leave to amend something they don't have standing to bring)
Are the Trump/McConnell judges on the 3rd Circuit?
I would think in the same vein they may allow them to amend the complaint. Undue delay may not be strong enough, as the district court basically said it didn't want to go through another round of briefing/oral args.
