The punishment should be to endure prosecution under it so it can give the courts opportunity to throw it out. Speech should be protected even if it's talking to other people we don't like.

I'm willing to bet that if Trump said something like this that they've got way more proof than just Kerry was "talking to someone we don't like." You're allowed to talk, you're not allowed to talk and pretend you rep the US and it's interests when you don't.
