Rulings under the Flores Settlement maintain that families cannot be detained for more than 20 days. To counter this, the Trump administration is “offering” families a binary choice: Remain detained as family or permit their child to be released to a sponsor & without the parent.

Parents we’ve spoken to told us that if they did not agree to their child being separated, the form claims that they "waived" their child's right to release.

Nationally 965 ICE detainees have tested positive for COVID-19 during the pandemic, according to the latest govt stats. As of May 9, ICE reported nearly 28,000 people in detention yet only 1,800 have been tested (as of May 11).

A choice to be separated from your child is no choice at all. We saw the traumatic effects of family separation in 2018. We know that separating a child from their parent results in lasting trauma. The government was ordered to halt their blanket separation policy in 2018.

Family separation should not happen now or ever. We shouldn’t be using COVID-19 as an excuse to return to family separation. We have seen detained families get extremely sick, and have already lost lives due to ICE’s refusal to follow court orders and release detained people.

The solution to this pandemic is not to continue to create more harm by separating families and forcing them to through all this, but rather to release them so that they can shelter in place with loved ones while pursuing their applications for protection in the United States.
