@tommybuck Where was the latter claim made? I understood pets to be saying that THESE bans were based in animus. -
@Profepps Agreed, but Alito's point was that reasons exist for man-woman def. other than animus, see Plato, etc., so we can't assume animus -
@tommybuck a point irrelevant to the point at hand, since the claim was about the facts of this case, not about all societies over time. -
@Profepps Plus, if Court decides on animus grounds, and common law had no animus, wouldn't common law man-woman def. still apply? -
@tommybuck I'm not aware of any principle that "animus" however defined is the only reason discrimination is invidious. -
