I just realized that this has been misread as "Communities should not have a Code Conduct", which is NOT what I wanted to say! Clearly, it can often be very helpful. It just cannot replace good intentions, mutual respect and human decency, and it may even sometimes be abused.

A lack of a code of conduct is an excellent opportunity for bullying and abuse by people who happen to lack good intentions, mutual respect and human decency.

A code of conduct never changes bad actors, and they will always find ways to circumvent or even use them, for instance by creating Kangaroo courts. Erroneous conduct of well intentioned people can usually be resolved, but bad actors cannot.

Just an observation based on reading mailing lists documenting how functional communities were invaded by malicious bullies that used the introduction of CoCs as a wedge. I am sure that CoCs can also often be benevolent and even a positive source of identity.

Which is why laws are much more narrow and restricted than CoCs, and their enforcement has elaborate standards of evidence, checks and appeal mechanisms.

I would argue that you (like me) are far at the top of the privilege hierarchy. A CoC is not *for* us. It is meant to be a helpful tool for those less fortunate. Good intentions are nice, but usually fly out of the window if it's a main contributor that's misbehaving.

I agree that CoCs can be very helpful to enable and shape a discourse on how to interact with each other, to express shared norms and values, and to reign in powerful group members that see their status as a license for antisocial behavior!
