As we know from Edward Snowden, the NSA can track anyone and collects everything already. We also know that their employees mishandle their privileges regularly for personal interest. So why even bother talking about data protection in the context of the United States?

The NSA is a spy agency, not a police force. That has important implications. The police or politicians generally cannot access such data, you cannot convicted without data being collected with a proper warrant etc.
