We say "We expect you'll take around 3 weeks of vacation per year, but we don't track it." Is that okay or still a red-flag?

I think that’s much better. Only way to improve it is to make sure bosses take full vacation, or require employees to do it

You are correct. I've even had a job with "unlimited time off" but also a conspicuously unwritten policy I discovered only after the fact.

it’s ubiquitous at small startups. In my limited exp. it wasn’t bad, but we did get the founders to switch to an explicit plan.
