"Immigration judges" are already DOJ employees; they're cosplaying members of the judiciary, but actually work for the Executive Branch. Your chances in asylum court are actually pretty good if you have competent counsel. The problem is essentially nobody has a lawyer. The de facto process is the one that Biden wants to make de jure.

I assume this will fsck immigrants in the US. In a well-managed country, the routine job of giving asylum seekers a fair shake would be the job of bureaucrats. That's what they do here in .nl.

Moving to the Netherlands was instructive. Government offices here have a fancy coffee/tea/hot chocolate machine *which is free*. The message is, "Sorry you have to wait, have a nice cup of something."
