Yes, and in this particular case I'd argue the lack of competition is the limiting factor. I dislike the power Amazon has accrued as much as anyone, but directly disallowing a company to enforce their own TOS is a solution that creates more problems than the narrow one it solves

This goes back to IP blocks being blacklisted for spam and routers getting DoSed for all customers. Hosts have had terms of service for years and years.

Lack of due process for spam IP blocks drove essentially all email on the Internet to 3 centralized providers, for what it’s worth.
