You would never know from this poor-me fixation on a judicial appointment that we are within striking distance of winning the presidency, the Senate and half a dozen state houses, provided we make an all-out effort to get people out to the polls (and their mailboxes) to vote

if only Congress would pass some sort of "Affordable Care Act" that the Supreme Court would obviously be unable to affect in any way

It might also be nice if we have a system in which a party which represents majority views and regularly gets a majority of the votes also had the power to control the agenda, but here we are.

Congress did pass the ACA, but whether it survives is up to the Supreme Court. Same is and will be true of a great deal more legislation. Best not to overcorrect here.

It's really not that bizarre. It's unclear whether Congress could constitutionally pass a law that protects abortion rights on a nationwide basis. Guess who would ultimately decide that question, and many others clearly in the judiciary's ballpark, including validity of ACA?
