My big concern with the government going after people for using outdoor spaces is that it makes the lockdown less tolerable, and shortens the time people will comply with it. I agree with you that whether groups are forming, and how people are behaving, is the central question

This is the problem and centralised legislation is a very blunt all or nothing hammer. We also need a strong enough police presence which has problems from resourcing and cultural viewpoints. People are already suggesting this is “house arrest” which isn’t true obv.
