Sure, but "impartial justice" is what impeachment is supposed to be. Also: 1. The indictment presumably doesn't automatically remove the President from office 2. Punting "impartial justice" to an executive-controlled branch runs counter to separation/balance of power principles

It’s a mechanism for removing the president from office without Congress having to take action. That’s why it’s preferable to them. Buck passing at its finest.

The proposal from
@ewarren is literally to have Congress pass legislation to allow DOJ to indict sitting presidents. It's transparently a ploy aimed at allowing prosecutors to indict Trump specifically, so I both don't understand how it's buckpassing or independent of Congress
