What's at question here is whether there's a two-tier system, where smaller companies have to comply with FTC rulings, and larger ones just buy their way out of compliance. Either we're regulating this stuff or we're not.

Where we’re talking past each other is that I think a $5B fine for a line of business that probably didn’t generate more than $50MM is in fact stern regulation.

Yeah, I see it as "Insert $5B coin to ignore FTC ruling" not tethered to any particular business activity. It's like getting a $200 parking ticket not because you deprived the city of $200 worth of parking, but to make you take the posted signs seriously.

Right, but just to be clear (sorry if I’m harping): I also see $5B as accomplishing that, because Facebook doesn’t make its money by directly selling private data to analytics firms.

I pretty much ignore parking tickets today for that reason, so I agree with you. But if parking tickets were $1000/pop, I could still metabolize them, but it would definitely alter my behavior.

My argument is that the fine is a $1000 parking ticket, and that we probably shouldn’t want the FTC to have the authority to make up $100,000 parking tickets.

I'd agree with you if the fine were for specific misbehavior that the FTC decided was bad. But the fine is for ignoring an FTC *consent decree*. If you tell the FTC you won't do the bad thing, and do the bad thing, they should have the power to turn you into a smoking crater.
