      Huge props to @Pinboard for pointing out that you don't automatically have a property right over data. The temptation to treat information like a finite quantity is so, so strong. But do I have a right to others' opinion about me? To a sketch someone makes of me? No, I don't.

      What about facts recorded about me? This is a better question. But it's typically unworkable to control what people know or think. A more promising avenue is to put controls on malign uses of that knowledge.

      Second! I don't see how we can complain about going through hundreds of consent dialogs & their associated unreadable legalese and then say we need an opt-in regime. That's what opt-in looks like (plus some additional advantage for incumbent giants).

      Last: it's tough to share complicated ideas in these settings. And Congress faces a lot of veto points. There is a real debate right now about whether privacy reform should include data breach provisions or revisit HIPAA/GLBA/COPPA.

      Some of that is about scope and design but it's mostly about politics and trying to balance reforms' ambition with what's achievable.

      ML-enabled discrimination is a fascinating and important topic. IMO there's no way Congress is going to figure it out right now. It's not clear they need to, either?

      I'm not sure the folks writing about this topic have taken a serious look at existing rulemaking and enforcement authorities or judicial precedent for addressing these harms (which are plausible but still mostly theoretical).

      There's a lot of legwork, whitepapers, badly catered lunch roundtables that need to happen before Congress is asked to act. That's not to say it shouldn't be talked about, but I'd encourage privacy reformers to take Congressional attention seriously as a finite constraint.

          I'm afraid at this point I mostly just have a hunch that people inventing clever ways to get around antidiscrimination laws predates CUDA & that regulators have a track record of dealing with it. I will tag @kristoncapps since housing is his beat & he foolishly RTed me
