This line of argument really bugs me. Not only does it violate the presumption of innocence, but the founders anticipated this very conflict and solved it by vesting the power to impeach in the House and Senate. They also vested the Senate with the right to consult and confirm supreme Court nominee. The argument that impeachment is the one and only sanction available is artificial, and ultimately harmful to the balance of power between branches.

Under a single sanction, either impeachment would occur for increasingly small political differences or so rarely that abuse by the executive would have to reach critical levels of danger. It is right and good to have and utilize multiple means of pressure.
