Not only does it violate the presumption of innocence, but the founders anticipated this very conflict and solved it by vesting the power to impeach in the House and Senate. Presumption of innocence is a trial standard — after the prosecution has had a full opportunity to marshal its evidence, a defendant is presumed innocent unless proven guilty by the evidence. There’s no presumption of innocence for the subject of an investigation.

@tribelaw is concerned about is giving the subject of a criminal investigation more leverage to hamper that investigation, not about prejudging him as guilty. -
I understand that, but limiting the power of a President to appoint judges by dint of being under investigation is not only a presumption of guilt, but gives the Department of Justice extraordinary veto power over judicial appointments.
