We’re pointing out here that a perp is in somebody’s house, gets shot, and then the homeowner is sued and loses. The laws are protecting the perp rather than the homeowner. That’s where this convo started, and that’s what I’m showing here. Happy reading! :)

First, the perp didn't win this case. That article is just saying that the trial can go forward. A jury will decide if the homeowner loses. I suspect the only reason it can go forward is because one side is claiming the perp was running away when shot thus unreasonable.

Again, the point being made here is that it’s disgusting that the homeowner or apartment dweller has to suffer ANY legal jeopardy when being put in the position of having to to defend themselves and others from aggressive perps who are there to harm.

I’ve had my truck stolen, my car burglarized, my wife had her car stolen and I’ve been physically assaulted. Twice. “Feeling bad for the bad guys” isn’t what I do. It’s not “on brand” for me. If a person breaks into my house at 3:00am, I’m going to tear his head off. And quickly.

FFS! Grandpa gets shot in the face, and gets sued when he defends himself-but nothing? Ok. I got you. I see you now. There’s no acknowledgement yet here of the fact that the homeowner is put in legal jeopardy by the actions of the perp! Is that fair? Is that what laws should do?

That is an unsolvable problem. You have to go court to decide that you don't have to be there. Stop crying about due process
