Oh no, so sad. He was and will always be a legend at George Mason. He spoke to my class about his keys to success in law school (spoiler alert: it involved *a lot* of hard work - like “how many hours are in this guy’s day?” hard work). Rest in peace.

If the 5th Circuit struck down $47K, I don't think the $83K proposal will fly (even in 2026). What are we thinking DOL will do here? Another crack at $47K (w/passage of time and huge inflation making it more justifiable)?

Thinking out loud here... would anything prevent an employer from putting a clause in a noncompete that says "we'll pay you $[X], but if the FTC final rule renders this unenforceable then ya gotta pay it back"?

I *love* seeing Fahrenheit 451 trend, but Bradbury has written sooo many phenomenal stories and books that seem to get overshadowed... Something Wicked This Way Comes, Martian Chronicles, Illustrated Man (collection), Dandelion Wine. I love them all!

The government is concerned with employer surveillance invading employee privacy and chilling protected activity. Hard not to contrast this with the government's own use "omni-surveillance":
