Minor question about the Jeffrey Clark DOJ story: Does it matter to our assessment of Clark's culpability if he genuinely believed the conspiracy theories of the 2020 election? A thread.https://www.nytimes.com/2021/01/24/us/politics/jeffrey-clark-trump-election.html …

A different but related question: if Congress had voted to deliver the election to Trump — meaning many of us would have (correctly) believed the election stolen — would we have supported a mob descending on DC to reverse it? What other option would we have had?

Was the mob action at the Capitol wrong because it was a violent attempt to change the declared results of an election—or because the election actually wasn’t stolen? What if Trump had actually managed to steal it? Would an uprising have been justified in trying to reverse that?

Sauce for the goose. We need to be very careful under what circumstances we justify lawlessness, because there will often be disagreement about the facts of a situation. As for my personal statement on the general topic:pic.twitter.com/Zv79EUso3q

(That "subject to the same" part refers to a previous paragraph on just war theory.)

In that scenario, I don't know if it would have been the wisest response for a mob to descend on DC, but I do think it would have been justified. Kind of like how a war might be morally justifiable while still not being wise.
