Protesters had filed a motion calling Ngo's suit a SLAPP — Strategic Lawsuit Against Public Participation. This legal principal exists because, in general, people sometimes file lawsuits they know they will lose, in order to punish defendants during the slog of a long trial.

Two of the named defendants (there are 50 unidentified John Does) have gone off the grid and have not been served papers. (You've seen this in movies: "You've been served!") That's been a stumbling block for Ngo's lawyers, who are seeking permission to serve summons by mail
