Protesters had filed a motion calling Ngo's suit a SLAPP — Strategic Lawsuit Against Public Participation. This legal principal exists because, in general, people sometimes file lawsuits they know they will lose, in order to punish defendants during the slog of a long trial.
But that didn't happen here. Multnomah County Judge Kathleen M. Dailey denied the special motion on Dec. 15. That *probably* means the case will proceed for quite a while, leading to things like discovery where both sides turn over relevant documentspic.twitter.com/nA0PAaeg54

The protester/defendant has been very adamant that this is all a case of mistake identity ....he went so far as to submit comparison photos to the court, as seen below Ngo said in written testimony that these photos are merely evidence of change in hairstyle/weight.pic.twitter.com/3LAjkswdPZ

Two of the named defendants (there are 50 unidentified John Does) have gone off the grid and have not been served papers. (You've seen this in movies: "You've been served!") That's been a stumbling block for Ngo's lawyers, who are seeking permission to serve summons by mail
Another interesting tidbit from the court docs: Ngo had less than 4,000 followers on social media before he started covering Antifa.
