Seems like the question should be “does disparate impact indicate ‘racism’?” To that I can only say “it might.” But in any event classical liberalism is safe since “business necessity” is the main defence against disparate impact claims.

I can frequently be glib (to the point of snide). Was not my goal. While I have heard executives complain about the costs of complying with Obamacare mandates, I have not heard them complain about the cost of “diversity mandates.” Does that mainly impact government contractors?

Well, anyone employing a diversity staff in HR is already bearing a dead-weight cost. IQ testing is forbidden for recruiters, compelling companies to use expensive proxies. And then there's the actual workforce distortion.
