given that the root of Michael Flynn's years long legal drama, one of the many areas that weighed down the Trump admin, was breaking the (never enforced) Logan Act to make foreign policy before Trump was President, I doubt team Biden are taking those risks.

On the contrary, it's highly likely that the Biden team is doing exactly that. It was only risky when it was expedient for opponents to make political capital out of it. Would also be very surprised, if certain back channels had not remained open with former Obama apparatchiks
