The disheartening part for me was the claim that he "got it done"-- referring to crim justice reform as a mission accomplished. It's not done. The First Step Act was meant to be a First Step. We still await steps 2 & 3 & 4. And Alice Johnson remains a sample size of one.

Now This did a great job with this video-- and gave me a chance to explain how the clemency system works (er... doesn't work).

“What I need people to understand is that this is not about partisanship and it’s not about politics,” said Leslie Redmond, president of the Minneapolis NAACP. “This is about justice. This is about what’s right and what’s wrong.”

Current problem: My 1L Crim Law students don't know who the Hamburglar is. This will be a problem when we get to the elements of hamburglary.

Crim Justice advocates ( ) often urge us to look at state processes, and they are right. This one makes for great theater, but also for inefficiency and unnecessary stress and disappointment for petitioners with good cases.

We have a good working example of a better process right next door in SD, which has an advisory board that makes recommendations to the governor, with the members of the board chosen by the Governor, AG, and CJ of the SC.

The petitioner also has to basically have permission of the Commissioner of Corrections before they even apply. And the vote of the 3-official panel must be unanimous. Not surprisingly, MN grants far fewer pardons than SC, GA, AR, etc-- and no commutations in decades.

We're working to fix the clemency process in Minnesota. Right now, that process requires a petitioner to personally plead their case directly to the Governor, the AG, and CJ of the SC, almost always without a lawyer. (a thread).

nice catch -- operating at the very outer edges of professional ethics.

The reaction of many to the impeachment trial is (in part) that just because someone is charged doesn't mean there must be a conviction. I hope they will remember that next time they have jury duty.
