Am I the only one who doesn't think that this is that big of a deal? I mean, they are not just using the code for a product or anything, just training an AI with it. At first, I thought they even used private repos as well and didn't think that would be that big of a deal as well

"training an ai", i. e. deep learning, is literally putting stuff in a matrix and then retrieving back a mashup of stuff thrown in before. if you do musical mashups, copyrights still apply. if you mix three functions for twitter api GET, all three from gpl repos, then...

What’s the legal distinction between a human being reading publicly available code and synthesizing it and an algorithm doing the same?

We have laws about machine reproduction. Copilot is a machine.

My computer that I clone public git repositories to is also a machine. That’s allowed. I’m not making any moral judgments about copilot but I’m struggling to find where the legal distinctions are here.

Then you need to read the GPL, because it's quite clear about this.
