Is there any precedent for training an AI on copyrighted content being a violation of said copyright?

I'd actually be looking for a music sampling copyright case in order to describe why this is legal or illegal.

I still think there's a huge distinction. Sampling in music is done with specific intent to create a new, transformative work, and specific selection of the piece sampled. Music also has a culture of borrowing, inspiration. It's also overt: acknowledged that a sample is used.

I feel it's time that we create some digital activism here. I imagine a software routine which randomly samples tones and chords from popular music in order to compose original works. We'll see how UMG's lawyers feel about the borrowing of their IP.

Honestly curious how long before standard licences include clauses about using the work in AI training datasets. Even if GitHub Copilot it is currently permitted under the letter of the law, IMO it's a blatant violation of the spirit of those licence agreements.
