I think this is allowed per the GitHub TOS. Also, if its public....I don't know if I would want to block something from being used as training data. Like, if I publish a public website, Google scrapes it by default and uses it to build a for-profit search...is this different?
Yes, because Copilot actually contains the copied code (since it can produce it verbatim).

Google contains the contents of every site and page it spiders.

Google is not passing that content off into a new license that may conflict with the origin.
