IANAL, but what seems interesting to me is the fact that feeding code into an algorithm doesn't trigger the GPL (r-o). Shipping some NN weights also doesn't, since it isn't code in any shape or form. The ones risking getting into trouble might be Copilot users themselves.
If that's the case, even though those NN weights can reproduce GPL code verbatim... what's different about, say, gzipping a Disney movie and distributing the archive? The Mouse'll whack the shit out of you for that.

I guess one can be transformed into a specific copyrighted work (and that specific work only) without further inputs, where the other can output "anything". That's the hard part: that "anything" could or could not be copyrighted work, and it's hard to tell. It's interesting :) -
