Well it's not packaged verbatim, only the result of analysis is - and the result is owned by the github. The network is simply to small to contain all the information stored in all public repositories, and most of that information is lost.
Sure - but if I gzip half your book and then make an HTTP service that send the unzipped text, I'm still infringing your copyright. Even if I do it with just a few paragraphs I am. This is the same, just more convoluted.

But that's not what github is doing. If you create Markov chain of words in my book, and then create service that is producing text based on that chain - will it infringe my copyright? Of course given that I allowed you to create that chain in the first place (as tos specifies)
