Yeah, to my mind it's exactly the same. I guess my question is, who would be considered "rolling those dice" - the person who published the tool, or the person who pressed the button? It's certainly not the neural network itself, despite any ML woo-woo.

The other thing is, you're supposed to get permission *before* you create a derivative work... unless it's "fair use" or similar, which is a mess of different rules in different jurisdictions.

If it's the person who created the tool, and GitHub didn't get that permission for repos that aren't licensed in ways that automatically allow it, Copilot itself is an infringement.
