GitHub Terms of service, D.4: (...) This license includes the right to do things like (...) parse it into a search index or otherwise analyze it on our servers; (...). So no, GitHub is not violating any copyright, but you as an user of copilot can by placing it in your code.
If "otherwise analyze" covers packaging it into a commercial product verbatim I would be very surprised.

Well it's not packaged verbatim, only the result of analysis is - and the result is owned by the github. The network is simply to small to contain all the information stored in all public repositories, and most of that information is lost.

Sure - but if I gzip half your book and then make an HTTP service that send the unzipped text, I'm still infringing your copyright. Even if I do it with just a few paragraphs I am. This is the same, just more convoluted.
